This matter is of grave urgency, as the final date to submit a petition to run in the Lower Brule Sioux Tribal Elections is Friday June 18, 2010 at 4:30 pm. Enrolled members with legal training who put in petitions to run for Chief Judge are being told that they must meet a position description which has not been modified into the 638 contract between the Lower Brule Sioux Tribe and BIA. contract #CTA15T34370. AFA Section G- Attachment 6 Position Description P.L. 93-638 Contract with the Lower Brule Sioux Tribe for Tribal Court Program is in direct conflict with the Lower Brule Sioux Tribal Constitution and By-Laws. The position for the elected position of Chief Judge does not state that the person seeking this position must reside on the reservation one year prior to running for office nor do they need to be an enrolled member of the Lower Brule Sioux Reservation, our Constitution does not state that a Juris Doctor degree is required. The BIA have eliminated the requirements of our LBST Constitution by not including that they must also reside on the reservation and be enrolled. The enrolled members of the LBST are held to a higher standard than the non enrolled members and non members who were contacted by mail by the election board in writing to apply for our election. The election board is using this job description to limit eligible enrolled members by putting on requirements that are not required by the LBST Constitution and have never been required. This election is corrupted and needs immediate intervention. Please contact me as soon as possible, if the US Government can help the IRAQ people run fair and legal election why won't they help us the native people of this land?
The stance of the BIA has always been to stay out of tribal politics but by creating this JD for an elected position they have created a corrupted tribal election. By only asking non enrolled people to run for offices that should be held by enrolled members disregarded the requirements of our Lower Brule Sioux Tribal Constitution. (THIS PROVES THE GOVENMENT DOESN"T CARE ABOUT THE NATIVE PEOPLE OF THIS LAND)
