A close look at this Powerline post and this one indicates that the supposed call from Howard Dean to Kansas governor Kathleen Sebelius never happened. Scott Johnson of Powerline suggests that the idea of the DNC suing people over this matter is an abuse of the law and thus constitutes thuggery on behalf of the Democratic National Committee. On the matter of the law I am not competent to judge, but it does seem a bit of an extreme reaction by a political group.
