Corporate farming

After the successful challenge to South Dakota's ban on corporate farming, a Nebraska state legislator is challenging that state's ban, according to an AP report in the Yankton Press & Dakotan headlined "Lawsuit To Challenge Nebraska's Corp. Farming Ban."

In other local legal news, the AP has a report headlined "EEOC suing Sioux Falls business over discrimination allegation."

Beef check-off case

The Argus Leader has an article today on the beef check-off case which will be argued before the U.S. Supreme Court on Wednesday headlined "U.S. Supreme Court to hear S.D. lawyer argue against beef checkoff."  The article contains a nice profile of South Dakota attorney Ron Parsons, who will be arguing the case alongside pre-eminent constitutional law scholar Laurence Tribe.

The Washington Post has an article today about the beef check-off case headlined "Justices to Hear Cattle Producers' Beef on Ads." 

The Grand Island (Neb.) Independent has an article headlined "U.S. Supreme Court to hear checkoff case."

Judge Piersol testifies before Senate panel

Judge Piersol, a federal trial judge here in South Dakota, testified before the Senate Judiciary Committee earlier this week regarding the recent Supreme Court ruling regarding federal sentencing guidelines. The Seattle Post-Intelligencer has the quote in a story headlined "High Court sentence views flummox judges."

8th Circuit reverses Judge Schreier's order striking down SD's abortion laws

The AP has a report headlined "Appeals court orders more proceedings in abortion laws challenge." Excerpt:


U.S. District Judge Karen Schreier of Rapid City in 2002 struck down laws that generally make it a crime to perform abortions outside a hospital after 12 weeks of pregnancy. The judge ruled that the requirement was unconstitutional because it imposed an undue burden on a woman's right to choose an abortion.

But a three judge panel of the 8th U.S. Circuit Court of Appeals in St. Louis reversed Schreier's decision, saying the judge must hold further proceedings to determine if the South Dakota laws are unconstitutional.
